Terms of Service
These terms are the agreement between you and Movd for using the Movd app and website during our private beta. They're written to be readable — but they're still a contract, so please read them.
Movd is not medical advice. It frames your activity to help you stay consistent. It does not diagnose, treat, or give health guidance. Always use your own judgment and talk to a doctor before changing how you train.
Accepting these terms
By joining the beta, creating an account, or using the Movd app or website, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use Movd.
The beta
Movd is currently an invite-only private beta. That means:
- The app is a work in progress and is provided “as is” — features may change, break, or disappear, and data may occasionally be reset.
- Access is by invitation and at our discretion; we may add, pause, or end the beta, or your access to it, at any time.
- We may contact you about your beta experience. We won't spam you — see the Privacy Policy for how we use your email.
- Beta builds are distributed through Apple TestFlight and are also subject to Apple's TestFlight terms.
Eligibility
To use Movd you must be at least 16 years old (or older if your country requires it), able to form a binding contract, and using a compatible iPhone. Movd reads data from Apple Health; an Apple Watch is optional and unlocks additional scoring.
Your account
An account is optional and used only for notifications and cross-device backup. If you create one, you're responsible for the activity under it and for keeping your sign-in secure. Tell us promptly at hello@movd.day if you believe your account has been compromised.
Health & safety
Movd is a motivation tool, not a medical device or a healthcare service. The Effort Score, streak, quests, and any activity framing are for general informational and motivational purposes only.
- Movd does not provide medical advice, diagnosis, or treatment, and nothing in the app should be treated as such.
- Consult a qualified healthcare professional before starting, changing, or intensifying any exercise program — especially if you have a medical condition or have been inactive.
- Listen to your body. Never train through pain or injury to protect a streak. Movd is explicitly designed so that rest counts and a missed day is forgiven — please use it that way.
- If you feel unwell while exercising, stop and seek medical help.
Acceptable use
Please use Movd lawfully and in good faith. You agree not to:
- reverse engineer, decompile, or attempt to extract source code, except where the law allows;
- interfere with, overload, or disrupt the app, the website, or our backend;
- access the service through automated means or scrape it, other than normal app use;
- submit false signup information, impersonate others, or abuse the invite system;
- use Movd to break the law or infringe anyone's rights.
Intellectual property
Movd, the Movd name and logo, the app, the website, and their design, code, and content are owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use Movd for your own non-commercial use during the beta. You keep ownership of your own data; we don't claim it.
Apple & third-party services
Movd runs on Apple platforms and relies on services including Apple HealthKit, iCloud/CloudKit, TestFlight, and our backend provider. Your use of those services is also governed by their own terms, and we aren't responsible for them. Apple is not a sponsor of, and is not responsible for, Movd.
Feedback
Beta feedback is gold to us. If you send ideas, bug reports, or suggestions, you grant us a free, perpetual right to use them to improve Movd, with no obligation to you. You won't send us anything you're not free to share.
Disclaimers
To the fullest extent permitted by law, Movd is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We don't warrant that scores are error-free, that the app will always be available, or that it will meet your expectations. This is a beta — expect rough edges.
Limitation of liability
To the fullest extent permitted by law, Movd and its team won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) Movd. Because the beta is provided free of charge, our total liability to you for any claim is limited to the greater of the amount you paid us (which is zero) or USD $50. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
Termination
You can stop using Movd and delete your account at any time. We may suspend or end your access to the beta at our discretion, including if you breach these terms. Sections that by their nature should survive — intellectual property, disclaimers, liability, and governing law — survive termination.
Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Oregon, unless your local consumer-protection law gives you the right to bring a claim elsewhere.
Changes & contact
We may update these terms as Movd evolves; the effective date above will change and, for material updates, we'll give notice in the app or by email. Continuing to use Movd after an update means you accept the new terms. Questions? Email hello@movd.day.
